All property will be offered and sold by Doug Dalton Auctioneer as agent for the Consignor on the following terms and conditions:
1. All property is sold “As Is” and ALL SALES ARE FINAL. Property is open to thorough public inspection, and it is the Bidders responsibility to determine condition, etc. Though all description and commentary are believed to be correct, neither Auctioneer nor Consignor makes any warranties or representations of any kind with respect to the property, and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, and condition. Under certain circumstances, Condition reports may be provided as a courtesy to prospective bidders, although every effort is made to ensure accuracy, Doug Dalton Auctioneer will not be held responsible for hidden damages, or damages occurring during transport to, from, or during the Auction. Doug Dalton Auctioneer suggest that prospective bidders take the opportunity to examine the Auction lots in person during provided preview to determine the condition of offered lots.
2. Notwithstanding the proceeding condition, if within 21 days of the sale of any lot, the purchaser gives notice in writing to Doug Dalton Auctioneer that the lot so sold is a counterfeit and, if within 14 days of such notice the purchasers returns the lot to Doug Dalton Auctioneer in the same condition as when sold, and proves beyond a reasonable doubt that the returned lot is in fact a counterfeit and that this was not indicated by a fair reading of a published description, the sale will be rescinded and the purchase price refunded.
3. Bidding at the Auction shall be by number only. Bidder must register prior to placing a bid. (Includes absentee) Bidders must provide legal proof of identification, current mailing address, and current telephone number. All identification documents are subject to review and approval. Bidders unable to provide satisfactory identification may be restricted to CASH ONLY purchases. Personal checks or Business checks payable above $5000 must be accomplice by a current bank letter of approval (letter must state maximum amount approved). Any checks including bank or cashiers checks presented for payment may be subject to electronic authorization, and the bidder may be required to present a credit card number as security. A bid by any person shall be conclusive proof that the person has made himself acquainted with these conditions of sale and has agreed to be bound by them.
4. The highest bidder acknowledged by the Auctioneer shall be the buyer. The Auctioneer has the right to reject any bid and to advance the bidding at his absolute discretion and, in the event of any dispute between bidders; the Auctioneer shall determine the successful bidder or reoffer and resell the article in dispute. Should there be any dispute after the sale, Doug Dalton Auctioneer’s record of final sales shall be conclusive. Any written mistakes made by clerks during the auction will be recognized as such by the Buyer and the Buyer will be obligated to pay the price as announced to the audience and the highest bidder during the Auction.
5. The purchase price payable by a Buyer shall be the sum of the final bid and a BUYERS PREMIUM may be imposed if previously advertised.
6. The vast majority of items offered for Auction are sold regardless of price, and without a minimum bid. On occasion, in order to offer the widest selection of merchandise possible, which would otherwise be unavailable for Auction, we may sell selected pieces subject to a fair reserve price. The reserve price shall be bid by the Auctioneer or employee and may not be made public. This policy is in accordance with MI laws.
7. Auctioneer reserves the right to withdraw any item before or during the Auction.
8. All Auction sales are final on the fall of the Auctioneers hammer. Any sales made, whether at live auction or privately between purchaser and Auctioneer or Sales Representative, shall be subject to all of the terms and conditions stipulated in this listing. On the fall of the Auctioneers hammer title to the offered lot (s) will pass to the highest bidder acknowledged by the Auctioneer, subject to fulfillment by such Bidder of all the conditions set forth herein and such bidder thereupon (a) assumes full risk and responsibility and therefore, (b) will pay the full purchase price thereafter. In the event the Auctioneer is required to institute legal action to collect payment in full for any reason, including, but not limited to, a stop payment order or non-sufficient funds with respect to a check, or refusal to pay a credit card billing, then Auctioneer shall be entitled to recover, in addition to the full amount due, interest at the maximum rate allowed by law and all of its legal expenses and court costs (including actual attorney fees). In addition to the other remedies available to us by law, we reserve the right to impose a service charge of 1.5% per month of the total purchase price if payment is not made in accordance with the conditions set forth herein. We also reserve the right to impose a storage charge and clerical fee of a minimum of $50 per month on all unpaid invoices. If the Buyer fails to comply with any of these conditions of sale we may cancel the sale, retaining as liquidated damages any payment made by the Buyer, and resell the property without reserve at public auction or privately on 7 days notice to the Buyer, or take such other action as we deem necessary or appropriate. If we resell the property, the original defaulting buyer shall be liable for the payment of any deficiency in the purchase price and all cost and expenses, including warehousing, the expenses of both sales, reasonable attorney’s fees, commissions, incidental damages and other charges hereunder. In the event that a buyer pays a portion of the purchase prince for any or all lots purchased, we shall apply the payments received to such lot (s) that we in our sole discretion deem appropriate. Payment will not be deemed to be made in full until we have collected, represented by checks, or in the case of bank or cashier’s checks, we have confirmed their authenticity.
9. The buyers shall pay applicable state and local sales tax, and any applicable compensating use tax of another state, which Doug Dalton Auctioneer may be required by law to collect, at the time of the payment of the purchase price.
10. It is our policy to protect the identity of any and all bidders and Consignors at our sales.
11. Auctioneer may facilitate the employment of porters, packers, and carriers as a convenience to purchasers, but assumes no responsibility for their actions.
12. Neither Auctioneer nor Consignor shall be liable for any personal injury on the premises where Auction shall be held.
13. As a convenience to clients who cannot attend an Auction in person, Doug Dalton Auctioneer will, if so instructed, execute written Absentee bids on the Bidder’s behalf, without additional cost. Absentee bidders should use the “Absentee Bid Form” provided at the Auction preview and note the terms and designations printed on each. Absentee bids will only be accepted AFTER the potential buyer has examined the items in person. Absentee bids without personal inspection will only be accepted by the Auctioneer if the potential buyer forwards a written statement that the buyer is purchasing the item “AS-IS”. No condition reports will be given over the phone. It is recommended that ANY potential bidders examine the items in person to determine condition. All absentee bids must be accompanied by a deposit of 25% of the total bid (s), payable by check, cash, or, should time be a hindrance, Visa, MasterCard and Discover. Doug Dalton Auctioneer or agents will not be responsible for errors or failure to execute bids. Lots are bought for absentee bidders at the lowest possible price subject to other bids and reserves.
